With the comprehensive development of the country’s Belt and Road Initiative strategy and the deepening of the integration process in the Greater Bay Area, the need for cross-border intellectual property dispute resolution has increased significantly. In order to enhance the foreign-related capabilities of lawyers and legal service professionals in Guangzhou, on November 22, 2025, the Legal Professional Committee of the Guangzhou Bar Association for the Guangdong-Hong Kong-Macao Greater Bay Area and Free Trade Zone, and the Legal Professional Committee of the Belt and Road Initiative, in collaboration with Beijing Longan (Guangzhou) Law Firm and other entities, organized the “Law Promotion Lecture Hall, Session 145: The International Legal Framework and Chinese Solutions for Cross-Border Intellectual Property Disputes” lecture.
The event featured a special presentation by Professor Yi Zaicheng, President of the Macao Intellectual Property Research Association and Assistant Dean of the Law School of Macao University of Science and Technology. He discussed key issues with experts and scholars involved in cross-border dispute resolution and intellectual property matters. Xie Xin, Deputy Director of the Legal Professional Committee of the Guangzhou Bar Association for the Guangdong-Hong Kong-Macao Greater Bay Area and Free Trade Zone and Senior Partner at Longan Guangzhou, served as the host of the event.

Professor Yi Zaicheng shared his insights on “Cross-Border Intellectual Property Dispute Resolution.” He said that cross-border intellectual property disputes pose challenges to traditional litigation and arbitration due to issues such as jurisdiction, legal application, and professional standards. Commercial mediation can effectively resolve these issues and improve economic efficiency. Using cases like OPPO v. Sharp and Huawei v. Canson, he explained recent developments in China’s judicial practice, such as “prohibition orders” and fines. He also introduced models like mediation by mainland courts and by the Intellectual Property Office. He emphasized the innovative cross-border mediation in the Guangdong-Hong Kong-Macao Greater Bay Area under the “one country, two systems, three legal systems” framework. Regarding the international legal framework, he explained the rules and mechanisms of WIPO’s arbitration and mediation centers, as well as the 70% success rate in settlements. He compared the advantages and disadvantages of mediation and arbitration, and explained the role of the Singapore Mediation Convention in enforcing settlement agreements. Finally, he proposed six suggestions for improving relevant reforms in mainland China based on WIPO’s mediation experience.

Lawyer Wu Rangjun, Senior Partner at Longan Guangzhou and Director of the Longan Bay Intellectual Property Research Center, hosted the roundtable session. Professor Yi Zaicheng, President of the Macao Intellectual Property Research Association and Assistant Dean of the Law School of Macao University of Science and Technology, Professor Tang Xi, Executive Dean of the Law School of Guangzhou Business University (Intellectual Property College), and Lawyer Zhang Shaowu, member of the Belt and Road Initiative Legal Professional Committee, shared their insights and practical experiences on recent intellectual property issues, common risks for Chinese enterprises in Belt and Road countries, and the development and training of intellectual property professionals.
In terms of trade secret protection, the guests analyzed policy directions in the context of US-China trade negotiations. They pointed out that the relevant laws have become more favorable for plaintiffs, but the burden of proof remains high. Rational advice should be provided to clients. In the field of intellectual property mediation, the guests believed that mediation in intellectual property cases is more effective, indicating the importance of mediation systems. It is important for mediators to have a deep understanding of the details of cases and to have reasonable expectations about the outcomes of trials and arbitrations, thereby improving clients’ understanding and facilitating efficient resolution of disputes. Additionally, the guests discussed the importance of integrating domestic laws with international rules and the systems of destination countries. Regarding the training of foreign-related intellectual property professionals, they shared ideas, platforms, and necessary skills and qualities from the perspectives of university training and team needs.

During the free discussion, the guests discussed issues such as “the recognition and enforcement of foreign court decisions on foreign patents in China” and “the choice of laws applicable to foreign copyright protection and anti-unfair competition laws.” They provided detailed answers based on practical cases. Participants said that this event not only enhanced their understanding of cross-border intellectual property dispute resolution systems but also helped them learn how to handle such cases.
The successful holding of this lecture on “The International Legal Framework and Chinese Solutions for Cross-Border Intellectual Property Disputes” not only provided a valuable platform for professionals in cross-border dispute resolution and intellectual property fields, but also shared practical insights and techniques.
