Recently, the “Pufa Hui Intellectual Property Salon (8th Session) – Practical Salon on Corporate Trade Secrets Protection and Risk Mitigation” was successfully held at Xin Building in Science City, Huangpu District, Guangzhou.

This event was sponsored by the Huangpu District Justice Bureau, Huangpu District Law Society, Huangpu District Social Construction Promotion Association, Guangzhou Semiconductor Association, and Guangzhou Intellectual Property Research Association’s Trade Secrets Professional Committee, and co-organized by the Longan Bay Intellectual Property Research Center, Guangzhou Xin Building, Guangzhou South China New Material Innovation Park Co., Ltd., and Yan Shang Game Law.

More than 50 representatives from the Huangpu District Justice Bureau of Guangzhou, the city’s Semiconductor Association, the Intellectual Property Research Association, and relevant enterprises and institutions participated. The salon was chaired by Lawyer Wu Rangjun, Deputy Director of the Management Committee and senior partner of Beijing Longan (Guangzhou) Law Firm.

At the beginning of the event, Pan Shaohua, Secretary-General of the Guangzhou Semiconductor Association, delivered an opening speech. She said that as a high-tech innovation hub in Guangzhou and even the Greater Bay Area, Huangpu District hosts many knowledge-intensive enterprises such as semiconductors. The purpose of this salon is to create a practical and efficient exchange platform to address the challenges and difficulties in corporate trade secret management. Through judicial guidance and practical discussions, it aims to help enterprises improve their risk early warning and mitigation capabilities, thereby ensuring the high-quality development of the regional economy.

After the speech, the event moved on to a special sharing session. Judge Liu Xiaopeng of the Guangzhou Intellectual Property Court first presented a talk titled “Prevention and Mitigation of Corporate Trade Secret Leakage”. Drawing on his extensive judicial experience, he explained the approach to handling trade secret cases in a simple and clear manner. He focused on the judicial criteria for determining trade secrets, and provided practical guidance on how to build evidence chains from the outset to effectively mitigate risks, addressing the difficulties enterprises face in litigation.

Next, Han Qiang, Intellectual Property Director of Guangzhou Tianci High-Tech Materials Co., Ltd., shared “Approaches to Building a Corporate Trade Secret Protection System”. Based on his front-line management experience, he outlined the key points of control throughout the process, from identifying core information and designing confidentiality systems, to physical and technical protection measures, and managing employees and partners. This provided a clear and actionable blueprint for establishing a robust protection system.

Professor Zeng Degang of Southwest University of Political Science and Law focused on the challenges in litigation. With the theme “Analyzing the Difficulties and Strategies in Trade Secret Appraisal from the Perspectives of Plaintiffs and Defendants”, he analyzed the strategic dynamics in key aspects such as determining the scope of appraisal and determining non-public knowledge. This provided solutions from both perspectives for enterprises and legal professionals, leading to extensive discussions among participants.

Finally, Wu Rangjun, Deputy Director of the Management Committee and senior partner of Beijing Longan (Guangzhou) Law Firm, discussed “Deciphering and Innovation: The Legal Boundaries and Risk Prevention of Trade Secret Reverse Engineering”. Using judicial interpretations, case studies, and legal theories, he analyzed twelve key legal issues related to reverse engineering. He clarified the legal boundaries between legal innovation and infringement, warned about common risks through case examples, and provided practical solutions on how enterprises can ensure compliant operations through proper procedures and evidence preservation.
