Lawyer Ou Yingshi gave a speech on the theme of “Response to US Anti-dumping Investigations”. Lawyer Ou first introduced the definition of anti-dumping, and then detailed the two main investigation agencies for anti-dumping investigations in the United States: the U.S. International Trade Commission (“ITC”) and the U.S. Department of Commerce (“DOC”); the entities that can file anti-dumping investigation applications (applications can be filed by relevant stakeholders or initiated by the U.S. Department of Commerce), and the procedures for anti-dumping investigations in the United States. Lawyer Ou reminded that due to the rapid progress of anti-dumping case investigations, the respondent should obtain the anti-dumping application as soon as possible to start preparing for the response. Then, Lawyer Ou introduced the basic contents of the notices and announcements of US anti-dumping investigations, including the effective date of the investigation announcement, the investigation period, the scope of the investigation, the determination of the level of industrial support, the sufficiency and accuracy of evidence of substantial damage, and the time limit for making the preliminary ruling. Subsequently, she specifically shared the four stages of anti-dumping investigations: ITC preliminary ruling – DOC preliminary ruling – DOC final ruling – ITC final ruling. During the sharing, Lawyer Pan specifically introduced how enterprises can check whether products belong to controlled items and whether license applications are required through the commercial control list. By analyzing the minimum percentage rules and foreign direct product rules in the “Export Administration Regulations”, she explained how Chinese enterprises should determine whether the products they produce belong to controlled “foreign products”. Lawyer Pan reminded that based on the general rules of countries/regions, export, re-export, and transfer of controlled items within a country to a specific end use and final user will face more stringent export control conditions. If enterprises violate the U.S. “Export Administration Regulations”, they may face criminal penalties, administrative sanctions, and other sanctions measures. Against the background of frequent Sino-US trade tensions, Lawyer Pan suggested that Chinese enterprises should conduct due diligence throughout the “supply chain-product-customer” chain and establish an internal compliance system to reduce the risk of being fined heavily or being included in an entity list due to violations of the “Export Administration Regulations”.
