On February 4th, a business exchange meeting jointly organized by the Professional Committee on Enforcement and Asset Disposal of the Guangzhou Lawyers Association and the Longan Bay Enforcement Law Research Center was successfully held at Beijing Longan (Guangzhou) Law Firm. This meeting focused on key practical issues such as the review of the enforcement of arbitration settlement orders, enforcement objections, and lawsuits against such objections.

Lawyer Zhou Junwei presented a presentation on “A Brief Discussion on the Legal Basis of Enforcement Objections and Lawsuits against Enforcement Objections.” Based on relevant provisions in the Civil Procedure Law (2023 Amendment), he explained two main types of objections: objections to enforcement actions, which focus on correcting errors in court enforcement actions, including property control, disposal, and mandatory performance; and objections to the subject matter of enforcement, which relate to the exclusion of the substantive rights of third parties to the subject matter of enforcement. He clarified the time limits for filing objections, and defined the corresponding time limits for different types of objections, providing guidance on when to file objections. He also outlined the key points of lawsuits against objections to the distribution plan for enforcement, including the scope of the case, the competent court, and the status of the parties, thereby clarifying the boundaries of actionable disputes and providing clear procedural guidance and practical methods for the lawyers present.

After a break, Lawyer Huang Qingfeng presented a presentation on “A Clear Judgment and Boundary Setting in the Enforcement of Arbitration Settlement Orders.” Using a typical case involving a housing sales contract dispute between Chen and Wang, he analyzed the different views of the three levels of courts regarding the clarity of the settlement order, the fulfillment of conditional obligations, and the validity of the arbitration correction documents. Lawyer Huang Qingfeng suggested that the review of the enforcement of arbitration settlement orders should follow the “overall relevance + operability” principle, avoiding fragmented enforcement. He also emphasized the principle of separation between enforcement and judgment, stating that the enforcement procedure only reviews procedural matters, while substantive disputes must be resolved through litigation or arbitration. He also discussed controversial issues such as the boundaries of arbitration settlement order corrections and the impact of the common rights of third parties on enforcement, as well as the “three-step judgment method” for similar cases, the precautions for arbitration institutions when drafting settlement orders, and key points for risk prevention for parties.
