Frequently Asked Questions

General information on common questions in this practice area. Advice on a specific matter depends on its facts and documents.

What filings are required to offer generative AI services to the public?

Under the Interim Measures for the Management of Generative AI Services, services with public opinion attributes or social mobilisation capacity must undergo security assessment and complete algorithm filing, amendment and deregistration procedures. Services built on a filed foundation model generally register with the local cyberspace authority. Training data sources, personal information processing and content safety controls should be reviewed before launch.

Does AI-generated content need to be labelled?

Yes. The Measures for Labelling AI-Generated Synthetic Content, effective 1 September 2025, require providers to add explicit labels to generated text, images, audio and video, and implicit labels in file metadata. Content distribution platforms also have identification and notice duties.

What routes are available for transferring personal information outside China?

The statutory routes are a CAC security assessment, filing a standard contract for personal information export, or personal information protection certification. The Provisions on Promoting and Regulating Cross-Border Data Flows set out exemptions such as concluding and performing cross-border contracts and cross-border HR management. Map the data types, volumes and recipients first, then select the route.

Does a company need a personal information protection compliance audit?

The Measures for Personal Information Protection Compliance Audits took effect on 1 May 2025. Processors handling the personal information of more than 10 million individuals must conduct an audit at least every two years, and regulators may require a professional audit where they identify significant risks or incidents. Other companies may use the Measures as a periodic self-check.
