On the afternoon of April 9, 2024, at the invitation of Zhuozhi Group, the legal team led by Lawyer Chen Gonghui from Beijing Longan (Guangzhou) Law Firm conducted a special lecture titled “Establishing Strong Defenses to Prevent Official Offenses” at the Harbor Center. The purpose was to further enhance the awareness of corporate executives regarding criminal risks. During the lecture, Lawyer Chen Gonghui, a senior partner at Longan Guangzhou, shared several practical issues related to common economic crimes committed by corporate executives. Lawyer Chen Luoyu from Longan Guangzhou focused on training on the investigation procedures of law enforcement agencies and skills for dealing with investigations.
Lawyer Chen Luoyu
Lawyer Chen Luoyu started by highlighting the urgency, seriousness, and unpredictability of corporate criminal compliance. Then, focusing on the investigation procedures of law enforcement agencies, she emphasized that companies need to understand which stage their investigations are in. She also explained the measures that public security organs may take at each stage, as well as the legal documents they issue. Regarding corporate criminal compliance, Lawyer Chen Luoyu suggested that companies establish both proactive and reactive early warning systems. Additionally, she provided training for employees on how to handle investigations during each stage. She also listed the responsibilities of administrative staff, front desk workers, receptionists, and those who provide evidence in investigations.

Following up on Lawyer Chen Luoyu’s discussion about corporate and employee criminal risks, Lawyer Chen Gonghui pointed out that companies need to prevent criminal risks, and executives must avoid them. Official offenses are close to every executive. Using data from the “2023 Entrepreneur Criminal Risk Analysis Report,” Lawyer Chen Gonghui listed the most common crimes committed by corporate executives over the past six years, such as illegal public savings collection and embezzlement. He also mentioned new crimes such as bribery and illegal business operations.
To help people understand official offenses, Lawyer Chen Gonghui created a short play called “Zhang San’s Workplace Adventures,” which includes six cases: “Equity Crowdfunding Traps,” “Golden蝉脱壳,” “Bank Card Management,” “Referrals,” “Bidding Collusion,” and “Starting Over.” These cases correspond to different crimes: illegal public savings collection, embezzlement, misappropriation of funds, bribery, bidding collusion, and illegal business operations. In addition to explaining the cases and crimes, Lawyer Chen Gonghui provided specific risk warnings and advice for each case. Finally, he revealed data on the reasons behind criminal offenses committed by corporate executives, as a final surprise.
Lawyer Chen Luoyu and Lawyer Chen Gonghui’s presentations were both theoretical and practical, and they received enthusiastic responses from the audience. During the presentation, Lawyer Chen Gonghui also showed legal services products developed by his team, such as guidelines for legal representation in criminal cases, methods and procedures for dealing with criminal investigations, and solutions for corporate criminal risks. Many executives expressed interest in these services.
At present, the incidence of criminal offenses committed by corporate executives is low due to internal supervision. This indicates that corporate internal control mechanisms are insufficient. In most cases, companies react passively to criminal risks. Therefore, establishing a proper system for corporate criminal compliance and implementing preventive measures will help companies handle criminal cases more effectively.
Longan Guangzhou will bring together many experienced criminal lawyers to provide high-quality legal services for corporate criminal compliance. This will help companies operate smoothly.
