Recently, the Longan Bay Area Legal, Tax, and Finance Integration Research Center and Guangdong Zheng China Sui Tax Agent Firm jointly organized a “Legal, Tax, and Finance” business exchange salon, aiming to promote the further development of legal, tax, and finance integration and discuss new paths for legal, tax, and finance construction.
Chen Banliang, director of the Longan Bay Area Legal, Tax, and Finance Integration Research Center, delivered an opening speech. He warmly welcomed the visit of Guangdong Zheng China Sui Tax Agent Firm. Lawyer Chen pointed out that the integration of taxation and law is an inevitable trend. There is great potential in areas such as tax compliance, law enforcement responses, and dispute resolution. This event will further promote deep cooperation between the two institutions and jointly advance the path of legal, tax, and finance integration.

The first part of the exchange focused on the topic of the “Company Law”.
Li Dingbang, deputy director of the Longan Bay Area Legal, Tax, and Finance Integration Research Center, shared his insights under the theme of “Interpretation of the New Company Law”. He started by explaining the amendment process of the Company Law, analyzed the key points and context of previous amendments, and then focused on important provisions of the new Company Law from multiple perspectives such as business operations, equity structure, and capital market. He also analyzed the impact and changes on legal services and tax services brought by the new amendments in terms of capital formation, equity restrictions, capital compensation, and corporate governance. He pointed out that legal, tax, and finance integration is the only way forward.
Mr. Li Jianye, partner of Guangdong Zheng China Sui Tax Agent Firm, shared his views under the theme of “Tax treatment of loss compensation under the new Company Law”. He focused on interpreting the legal provisions in the new Company Law regarding the use of company reserve funds for loss compensation. Based on his many years of tax experience, he analyzed the differences in company tax treatment before and after the amendments from a practical perspective. He then analyzed the changes in tax treatment for company losses after the new amendments and shared his views and insights on practical handling based on real-world tax cases.
The second part of the exchange focused on “Judicial interpretations by the Supreme People’s Court and Supreme People’s Procuratorate regarding crimes that harm tax collection and management”.
Hao Hao, deputy director of the Longan Bay Area Legal, Tax, and Finance Integration Research Center, shared his insights under the theme of “Judicial interpretations by the Supreme People’s Court and Supreme People’s Procuratorate regarding crimes that harm tax collection and management – The crime of issuing false value-added tax special invoices and the issue of tax losses”. Starting from understanding the spirit of the interpretations, Mr. Hao began by explaining the “restriction” and “division” of crimes related to false value-added tax special invoices. He then reviewed the elements of this crime and summarized the judicial认定 and changes. Focusing on the concept of “tax losses”, Mr. Hao used typical cases from the Supreme People’s Court and his own cases to discuss the subtle differences in views between the judicial and prosecution systems. He also discussed how to strengthen reasoning from accounting, tax law, and criminal law perspectives to protect clients’ rights.
Mr. Huang Wen, partner of Guangdong Zheng China Sui Tax Agent Firm, shared his views under the theme of “Highlights and deficiencies of the judicial interpretations by the Supreme People’s Court and Supreme People’s Procuratorate regarding tax evasion”. Mr. Huang analyzed the new changes in the judicial interpretations. Based on his many years of tax industry experience, he focused on the crime of tax evasion. From a tax perspective, he explained the changes in the provisions related to tax evasion. He analyzed the content of the provisions, administrative prerequisites, conviction and sentencing amounts, and calculation standards. From a tax industry perspective, he explained the various highlights of the amendments. Using classic cases before and after the new judicial interpretations, he analyzed the impact of the amendments on the handling of tax evasion cases. Finally, Mr. Huang pointed out the deficiencies of the crime of tax evasion from both criminal and administrative perspectives, and shared his new ideas for the development of legal and tax integration.
After the sharing session, both parties discussed the amendments to the new Company Law and the new judicial interpretations by the Supreme People’s Court and Supreme People’s Procuratorate. They engaged in honest and in-depth discussions on complex and important issues in theory and practice. The atmosphere at the meeting was lively, and all participants highly recognized the significance of this exchange and learning in the legal and accounting tax industries. Guangdong Zheng China Sui Tax Agent Firm was established in 1991. It was originally called Guangzhou Tax Consulting Firm and was under the jurisdiction of the former Guangzhou State Tax Bureau. Its headquarters is located in Guangzhou, with branches in Panyu, Shaoguan, Zengcheng, and Zhongshan.
