The case of Jian Moumou regarding tax issues: This is a typical criminal risk case caused by business model innovation. Jian Moumou’s company B cooperates with Hunan Company A in e-commerce operations. Due to platform rules, all revenue must flow back to Company A’s account, causing great financial pressure on B. To maintain the company’s survival, Jian Moumou, advised by a third-party financial advisor, introduced the C employment platform for settlement and invoicing. This model was later identified as potentially involving the crime of illegally purchasing special VAT invoices, and Jian Moumou was placed under criminal investigation. After our team intervened, a meticulous “dual-line defense” strategy was developed. On one hand, for Jian Moumou personally, we emphasized that his actions were to solve real operational difficulties, with the intention of normal company operation rather than tax evasion, and the transaction background was genuine. We also actively organized evidence to prove that he had sought “professional advice,” effectively reducing his subjective malice. On the other hand, we provided specialized criminal risk isolation services to Company B, reviewing all business contracts and financial transactions, and issuing compliance reports to prove the legitimacy of the company’s operations. Eventually, the procuratorial organ accepted our opinion, and a decision not to prosecute Jian Moumou was made. Company B was also not held accountable, achieving the unity of legal and social effects.
(2) Criminal Complaints
The case of Liu Moumou’s complaint against fraud: This is a dispute arising from handling specific affairs. The complainant believes that the other party, after receiving fees, failed to fulfill the agreement and refused to refund, which is suspected of fraud. After accepting the commission, our team guided the complainant in systematically collecting and preserving relevant electronic evidence, written materials, and financial transactions. We also prepared a criminal complaint document based on criminal law provisions, clearly explaining the legal reasons for the alleged crime. The team then submitted all evidence and legal opinions to the public security organs. After review, the public security organs accepted the case and began investigation.
(3) Criminal Representation
The case of He Moumou’s fraud: This was a long and difficult journey to protect rights. In November 2022, we accepted the commission of several victims to report He Moumou’s crime of defrauding hundreds of thousands of yuan in pension funds under the pretext of high-interest loans. Due to the long time period and complex evidence, the investigation progressed slowly at the beginning. In July 2023, we successfully forced the public security organs to officially start investigation. However, after the investigation began, it stagnated, and the suspect was not taken into custody. In response, we submitted detailed “accelerated investigation suggestions” to the investigation authorities, explaining that the case was ready for investigation, the suspect had significant risks of evasion and destroying evidence, and the victims’ situation was urgent and required judicial relief. Eventually, He Moumou was arrested in January 2025. During the trial, facing the defendant’s refusal to plead guilty, we systematically exposed the nature of his crime of fabricating repayment ability and spending the fraud money on gambling, and detailed his abnormal financial flows, pointing out possible asset transfer clues. We strongly requested the court to pay attention and continue to pursue the case. Eventually, the main offender He Moumou was sentenced to twelve years in prison and a fine.
(4) Civil Disputes
The case of Chen Moumou’s guarantee contract dispute: The challenge was to oppose a civil judgment that had been in effect for over sixteen years. In the 1990s, Chen Moumou provided a guarantee for a loan. Later, due to creditor demands, he was缺席 sentenced in 2006 to bear guarantee responsibilities, but he was unaware of this for a long time. In 2022, he learned of this only after his assets were frozen. After our team took over, we identified two major issues: serious violations in the “detention delivery” procedure and an error in the “guarantee period.” We applied for a retrial with the original court, but it was rejected. Then, we turned to the civil procuratorial supervision procedure and submitted a detailed legal opinion to the procuratorial organ, combining procedural violations with substantive errors, arguing that the original judgment was indeed wrong and damaged judicial fairness. After a year of continuous communication and further argumentation, the procuratorial organ accepted our view and issued a procuratorial suggestion for retrial. After the court ordered a retrial, we continued our efforts and finally obtained a full revision of the judgment.
