Lawyer Peng Limin
Senior Partner of Longan Guangzhou, Senior Expert Advisor of the Longan Bay Criminal Prevention and Control Research Center
Lawyer Peng Limin shared his insights on a case involving a gas company accused of producing and selling products that do not meet safety standards. He first explained the facts of the case, and then discussed five key points of dispute. Based on the prosecution’s arguments, evidence, and legal basis, he presented strong defense arguments regarding industry safety standards, the legitimacy of analysis reports, product liability, and the relationship between regular inspections of gas facilities and the consequences of explosions. Finally, the court ruled that the available evidence did not prove that the gas company knew or should have known that the liquefied petroleum gas it sold did not meet safety standards, nor did it prove that the explosions occurred due to failure to carry out regular safety checks. Therefore, the court accepted the defense argument of “innocence”.

Lawyer Luo Jie’s presentation focused on “Seeking Survival in a Dead End: The Case of Chen’s Drug Transportation and Death Penalty Rejection”. He discussed the key points of defense during the death penalty review phase. He explained that it was difficult for Chen, as the main offender and first defendant, to defend himself during this phase. Through analysis of some evidence, Lawyer Luo Jie found that there were important facts that were not clear enough for the court to determine, which affected Chen’s conviction and sentencing. Eventually, the Supreme People’s Court decided not to approve the death penalty and ordered a retrial.
Lawyer Chi Meng
Senior Partner of Longan Guangzhou, Deputy Secretary-General of the Longan Bay Criminal Prevention and Control Research Center
Lawyer Chi Meng shared his insights on “The Story of ‘Blue Fairy’ – A Case of Drug Smuggling Without Prosecution”. He mentioned that “Blue Fairy” refers to flunitrazepam, a type of psychotropic drug in China. He explained the facts of the case briefly and developed a strategy for defense based on eight key points of dispute during the criminal phase. To defend against this case, Lawyer Chi Meng helped the client provide sufficient evidence, thereby eliminating the “drug” nature of the substance involved. He also analyzed the “smuggling” behavior in detail. Finally, he argued that both the “drug” and “smuggling” charges were not valid. The case was resolved without prosecution, and the client was not subject to any administrative penalties. Lawyer Chi Meng emphasized that emotional value is important in criminal defense, both in terms of professional competence and human care.
This “First Session of Classic Case Seminar – Criminal Case Special” event allowed for deep exchange of experience and wisdom through the sharing of practical cases by three experienced criminal lawyers. It also created a high-quality professional exchange platform for the lawyers in the firm, promoting cooperation and resource integration among different business teams in Longan Guangzhou. This is important for enhancing the professionalism of the firm.
In the future, the Longan Bay Criminal Prevention and Control Research Center and Longan Guangzhou Law Firm will continue to invite experts from various fields within the Longan system to hold seminars on classic cases, thereby promoting the transfer of expertise from high-quality cases and improving legal services for clients.
